Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you and KTech Clans governing your access to and use of the Service.

1. Acceptance of Terms

By creating an account, downloading, accessing, or otherwise using KTech Clans, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization or clan, you represent that you have the authority to bind that organization to these Terms.

You must be at least the minimum age required under the laws of your jurisdiction to use the Service, and, if under the age of majority in your jurisdiction, you must have the consent of a parent or legal guardian. If you do not meet these requirements, you may not use the Service.

2. User Conduct

You agree to use KTech Clans respectfully and lawfully. Without limiting the generality of the foregoing, you agree that you will not:

• Engage in any activity that is illegal, fraudulent, or violates the rights of others.
• Harass, bully, threaten, defame, stalk, or intimidate other users or KTech Clans staff.
• Post or transmit hate speech, discriminatory content, or content that promotes violence.
• Use cheats, bots, exploits, hacks, unauthorized third-party software, or automation tools to gain an unfair advantage.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity, including KTech Clans staff.
• Spam, phish, or send unsolicited commercial communications to other users.
• Upload viruses, malware, or other harmful code, or attempt to interfere with the security or integrity of the Service.
• Infringe upon or misappropriate any intellectual property, privacy, or publicity rights of KTech Clans or any third party.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service, except as permitted by applicable law.
• Buy, sell, or trade accounts, items, or in-game currency outside of officially sanctioned channels.
• Circumvent or attempt to circumvent any content moderation, security, or access-control measures.

We reserve the right, but not the obligation, to monitor, review, and remove content or restrict access for any violation of these Terms, at our sole discretion.

3. Intellectual Property
3.1 KTech Clans’s Content

The Service, including its software, design, graphics, logos, trademarks, audio, and all other content provided by KTech Clans (excluding User Content, as defined below), is owned by KTech Clans or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, or lease any part of the Service.

3.2 User Content

You retain ownership of any content you create, upload, or share through the Service (“User Content”), such as clan banners, messages, screenshots, and profile customizations. By submitting User Content, you grant KTech Clans a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify, display, and distribute your User Content solely for the purposes of operating, promoting, and improving the Service.

You represent and warrant that you own or have the necessary rights to your User Content, and that it does not infringe the rights of any third party or violate any applicable law.

3.3 Feedback

If you provide suggestions, ideas, or feedback about the Service, you agree that KTech Clans may use such feedback without any obligation to compensate you or attribute it to you.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must provide accurate, current, and complete information when creating your account and keep it up to date.
• You must notify us promptly if you become aware of any unauthorized use of your account or any other breach of security.
• You may only maintain one active account per person, unless otherwise authorized in writing by KTech Clans.
• KTech Clans reserves the right to suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or illegal activity, or created risk or possible legal exposure for KTech Clans or other users.
• You may terminate your account at any time by following the account deletion process within the Service or by contacting support.

5. Disclaimers and Limitation of Liability
5.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. KTECH CLANS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, OR THAT ANY DEFECTS WILL BE CORRECTED.

5.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KTECH CLANS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

IN NO EVENT SHALL KTECH CLANS’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO KTECH CLANS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) [NOMINAL AMOUNT, E.G., USD $100].

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

6. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [GOVERNING JURISDICTION, E.G., STATE/COUNTRY], without regard to its conflict-of-law principles, except where mandatory local consumer protection laws provide otherwise.

6.1 Informal Resolution

Before initiating any formal dispute proceeding, you agree to first contact us to attempt to resolve the dispute informally.

6.2 Arbitration

Except where prohibited by applicable law, any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by [ARBITRATION BODY, E.G., AAA / JAMS / EQUIVALENT], on an individual basis, rather than in court, except that either party may bring an individual action in small claims court. YOU AND KTECH CLANS EACH WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

Where arbitration is not permitted by applicable law (including for certain consumer disputes in some jurisdictions), disputes shall be subject to the exclusive jurisdiction of the courts located in the governing jurisdiction identified above.

7. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will provide notice by posting an update within the Service, updating the “Last Updated” date, and/or sending you an email or in-app notification. Your continued use of the Service after such changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without cause or notice, including for violation of these Terms, extended inactivity, or as required by law.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimers and Limitation of Liability, and Governing Law and Dispute Resolution) shall survive.

9. Miscellaneous

• Entire Agreement: These Terms, together with the Privacy Policy and any additional guidelines posted within the Service, constitute the entire agreement between you and KTech Clans regarding the Service.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
• No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
• Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
• Force Majeure: KTech Clans shall not be liable for any failure to perform due to causes beyond our reasonable control.
